First Turn Fog of War Non-Conquering Rule

When going first, all players must not, under any circumstances, take any regions from their opponents (or neutral player). Depleting an opponent's region (or neutral region) is allowed, but conquering it will result in losing the game in question.

Game 9679058 would break this rule right> green starts, takes a territ in turn one and thats bad right?
