Compensation in China

Compensation is used to settle most minor disputes, from car accidents to fighting. The people like it because it cuts out the middle man, the authorities. The authorities like it because it relieves them of dealing with infractions.

A family in China pools their resources. When compensation is paid, it is usually from the family pool and the family metes out the applicable punishment to the member after they have compensated the wronged family.

This carries into modern law. If you hit someone smaller than you, for example a car hits a motorcycle, or a cyclist hits a pedestrian, the bigger vehicle is automatically declared guilty (this has slightly changed in recent years, but take it as a rule of thumb). According to law, the first act is for the involved parties to agree independently on compensation. If they can't, then it is the police's job to insist they come to an arrangement. If they refuse, the police are then the mediators of the arrangement, if this fails then it goes to the courts. If a minor case arrives at the courts, it is taken as a failure by the police. Chinese police have very limited responsibilities and failing in their clear and direct one is not praised.

So in general, compensate. If you have been established to be at fault, then allow the other party to make a proposition (they might talk to the police and agree to share). Counter with a much lower offer. If you refuse to counter, then the police will focus their attention on you. You must counter. When you do, say it is all you can get at the moment and might be able to arrange more later. Once the case is closed, there is no binding process to make you pay the future money. In countering so low, it will be taken as an insult and the police will realize that their " share" isn't worth the effort and will focus on closing the case. That is, the pressure goes to the wronged party to accept the money. If you are a foreigner, they don't have the concept of your family paying and they have no real idea how much you possible can pay. In general, you will get away with paying a paltry sum or nothing.

In a more serious case, take action quickly offering a respectable but low offer in exchange for a guarantee against prosecution.

I have gone wandering alone in most areas of my city. Driven at night mostly highways if in the us and france. Pretty much stayed out of trouble. Been at a bar when someone had a gun out but didn't even see it. Talked with the bouncer that took it off the guy. Have not seen any knife fighting up close.

I have been shot at but it was my cousin playing around. Different type of dangerous from someone trying to actually shoot me instead of something too close to me.

Never really had a good beating or fist fight but I'm pretty diplomatic and kind of gentle. If things went down wrong I would not take a chance with some young scarred guy. One of us might get hurt pretty bad.

In a true no fault accident the size thing is quite sensible yet. I keep lamenting about the pedestrians that just walk out in front of cars because they have the right of way here. Yes it's good that a car has to stop for them otherwise you would never get to cross. It's bad that they tend toward, "I'm going to teach this driver to look out for me by walking in front of their car."

Sorry I have limited pity for that kind of person if the car can't stop. Second don't dress like a ninja after dark, I would have stopped if I could see you.

This is not the out of context quote thread. Dressing like a ninja is awesome. Definitely do it!

Just don't walk in front of my car in the dark then complain when I was not planning to stop as I didn't see your dumb ass. If you want to cross the street. Wear a reflector or flashing light.

Here's your innocent biker. The first video shows him hit the lady from a street camera and the third video was filmed at the scene. He was trying to help her up and off his bike so he could leave.

The first and third videos are making me racist. I hope his home country lets him stay in jail when he eventually gets put away. Even if he gets away with this a person like him will do some other nasty thing worth punishment. There's why they are "unfair" toward foreigners.

If you drive your Japanese car like that guy rides a scooter I'd consider it. You figure he was just pulling a "When in Rome..."?

He was 100% at fault then tried to bully his way out of the whole thing. What a giant asshole!

I would say that the guy is in the second stage of Sinafication. He knows enough to try to get away. In the third stage, he will learn to do so gracefully.

I saw surveillance footage of a Chinese guy riding his scooter too fast across a pedestrian crossing and hitting a woman who was on her push bike (knocking her off). His reaction was to jump off his scooter and start punching her.

And the white guy that swerved around traffic to hit the lady may have learned from locals. That does not make it ok.

I'm sure there are times (probably many) when their system allows scammers to take advantage of foreigners and that's wrong too.

I'm not saying I think it's ok to abuse foreigners. I know it's very wrong to lump decent white people in with that scooter rider. I'm not surprised they do it though.

If they see something like that a few times then rarely interact with any other person that looks like that. People always exaggerate things on top of it. It's difficult not to assume, "All white people..."

Update for the story about the foreigner who hit the woman while riding his scooter/bike. He has now been deported, along with his father (who was also in BJ).

That guy on the scooter liked the country because up until that point he was getting away with being a total scum bag and bully. It's nice to see him sent home.
