STD's

I think there might already be a topic about this, but I can't find it.

If a woman has an STD, whether it's AIDS or Herpes etc, should she be required by law disclose this information to her partner prior to copulation? What if she doesn't and gives you the HIV? Should she be charged with Manslaughter? What about the Herpes? Should she be charged with criminal assault or something?

(Same question for the opposite, where man has disease and needs to inform woman, or Lesbians and Gays as well)

Most people don't know that they have the diseases, though. If you made it mandatory, you'd have to make checkups mandatory too. :?

If prior knowledge can be proven, then most definitely hit them with something. Manslaughter isn't quite right, it almost deserves a category of its own.

Either way, I've heard some over the top stories. I forget where I heard this (some presentation from back when I was in high school), but I heard about a nurse who, after giving some guy test results showing him to be HIV Positive, watched as he told his girlfriend he was clean. They hugged and walked off...the funny thing is, if she'd warned the girl she could have been sued.

I completely agree. it hinges on "prior knowledge" because you can only inform a potential partner of a condition if you are aware you have it. So would this lead to people not getting tested?

If you know you've got the HIV, and you give it to somebody else, I think you should be charged with murder. HIV is basically a death sentence unless you are Magic Johnson.

No, not at all. I just believe people should be allowed to make informed decisions. Not telling your potential partner that you have a deadly disease that is passed by sexual contact and them then becoming infected with said deadly disease is paramount to murder in my opinion.

Criminal negligence is probably the most you could get.

I thought there were already laws that HIV patients had to disclose it to their partners, but I could be wrong. The disease doesn't affect me, so I don't pay attention to that type of stuff.

Tell that to the 40-something homosexual pot-smoking bi-polar guy I know that's been HIV positive for years now. HIV used to be a death sentence, but now they have enough drugs to have you lead a fairly normal life. It sucks, sure. But it's not a death sentence by any means.

Also, I think if you're caught knowingly transmitting HIV you can be charged.

Which is how it should be. Despite not being a death sentence, it's still a very negative affect on your life, and so it should be a criminal offence.

Thanks for the link Hecter. I wonder if there is something similar for Herpes. It doesn't kill you, but you have to live with it for the rest of your life.

Wouldn't this just completely disclose any sense of mystery or suspense in a budding relationship? And what ever happened to loving a person for who they are instead of what they don't have? You damn moralist's are all the same!
