The main function of the 'foe' list, is to help ensure that players don't have to play against anyone they choose to not play against. It shouldn't have anything to do with who started the game.
For example, let's suppose that I don't want to play against you (have made you my 'foe'), I'm not going to care if I started the game, or joined it later. I don't want to play you. If your suggestion were implemented, anyone who wished to have their 'foe' list honoured, would have to make sure they started every game they played in (or were the last to join).
I will admit, sometimes it's frustrating to invite people to a game I started, only to find out that they are on someone else in the games' 'foe' list. I those situations, I will ask if they will remove the 'foe' so we can play. Sometimes it works, sometimes it doesn't.
