2 questions

Two questions:

1.If someone came into the local grocery store and randomly shot your child, your parent, your sibling or good friend, how would you feel?

2. How would you feel if that same person were killed by a drunk driver?


I would guess you would feel about the same. Why then should a drunk drivers get probation or 2 years in jaul (in many, many US jurisdictions), while a shooter will almost certainly get at least 10 years?

Because the first one, they meant to kill someone. Maybe not your loved one, but someone.

The second one was an accident.

At least, that's what the law sees.
Even if both killed someone.

Because 1. is murder and 2. is manslaughter

Manslaughter carries a lower penalty than murder

1. Pissed off until I captured him, mutilated him, and let him bleed to death. Then I would feel slightly better that someone like that is no longer around.
2. Pissed, if not to the same degree, as it usually is not intentional whereas the previous one generally is.

I guess I would say something like that. The law distinguishes between different kinds of killings, manslaughter, 1st degree murder, etc., based largely on intent. Penalties for killing someone while drunk driving have been made more strict than they used to be (or so I thought) on the reasoning that it's not totally an accident. I think most people would agree that is as it should be. The drunk driver didn't intend to kill anyone, but he chose to drive while intoxicated, so he bears more responsibility than in just a pure accident.

In this case, one intended to kill someone, while the other didn't, accounting for the difference in penalty. It's another question whether the difference is greater than it should be.
The right answer to the wrong question is still the wrong answer to the real question.

Because 1. is murder and 2. is manslaughter

2. Is also, involuntary manslaughter. And surprisingly, you do get jail time for hitting and killing someone while DUI. Who would of guessed that two crimes gets you that. And 1., murder is 15/25 to life, depending on the previous record and current "state of mind" there could be a parole or admission to a mental asylum.

As per my feelings, I would take the very same gun, shove it up there perps ass and shoot them. I wouldn't kill them, I'd make them suffer. If they shot and killed them, well then I would unload the rest of their clip in their head.

And for 2. I would take a keg of beer and shove it down their throat, then hit them with their own car, and drive over their body until they are surely dead.

It's a pretty standard reaction, really.

Wow, Strife's complete breakdown on GD yesterday is starting to make sense now.

This guy is one sick puppy. He needs about 6 years of therapy if this kind stuff is what he fantasizes about. :-s I'm going to make a comment about it on my Twitter account, I think.

I think he should be banned for his last stunt in GD, claiming to be dead, and being his sister, then as soon as he found out that it was a bannable offense allowing his 'sister' to take over his account, switched tactics and decided to claim "I waz hackzors!"

But no, they only hand out bans now for things like quoting actual posts pseudo-mods have made, displaying them to be hypocrites.

Actually, I'd want to do the same thing.
I think other people agree.
I wouldn't actually do it, because I lack the testosterone and gumption such a thing requires, but I would certainly want to!
But to make things.... clear: normal human emotions that happen after a loved one is killed, like revenge, is cause for 6 years of therapy?

I think you may need it too.

Strange. You seem to be implying that the punishment for a crime should be determined strictly by how the parent, child, sibling, or friend of a victim feels.

Surely you know that you are over-simplifying things.

Two thoughts:
1. I very much believe in both the legalization of drugs and the harsh penalty for offenders such as in #2.
2. That being said, I think it's VERY important that the law consider "intent" (as much as it can be determined, of course) to be a major part in determining punishment.
...I prefer a man who will burn the flag and then wrap himself in the Constitution to a man who will burn the Constitution and then wrap himself in the flag.

In the first instance that person has decided to take the life of another and have accepted the consequences of doing so, what is the likelihood that they will show remorse? They want to take someone's life and end up taking an unintended bystanders life instead, they've forsaken respect for the sanctity of life, they're not going to suffer the guilt of the person in the second instance.

Because the person in the second instance will be tortured by the memory of their negligent behaviour, a guilty conscience is a greater punishment than anything the penal system can hand out. They will have to live with it for the rest of their lives, unlike the person in the first instance who wanted to kill, they cannot ignore the impact they've had on others.

Hmm, if someone killed one of my families members, and then that person was killed by a drunk driver, I would say they got what they deserved.
