I thought that homo sapiens survived and the neanderthals died out during the last ice age because the neanderthals had a larger body mass and couldn't find enough food since they needed more calories per day than homo sapiens?

Good question and one I don't know the answer to.

However, I'm pretty sure contractual language cannot remove constitutional rights.

erhh was going to stay out of this particular debate, but I do know the answer, since our neighbor did a surrogacy and ... there was a lot of local debate.

Anyway, contracts specify everything. Some specify an abortion may happen only if deemed medically necesary (some specify things in a very detailed manner), some have more general clauses -- that say basically if the contract is violated by the mother having an abortion or doing any number of other things, the money must be paid back. There are some "standard" contracts, but exact details of course vary by state.. even whether any contract is legal, though I think most states do allow for this in one form or another. So far, judges have essentially ruled that the contract stands, but this is a new area of law. Some argue, in this and even sperm donation cases that the child's rights still stand.
