So generally there can be used two principles for a solution:
1. Older claimers have priority... not true, aboriginals all over the world understand thats not true.

2. You know that's not an actual law, right? Or anything that is remotely ethically justified? It's an idiom. Idioms aren't based in legal code.

Not sure if you noticed but the last time law actually ment anything was under monarchy or dictatorship.
And law under that system could change at any moment.
